A Fayetteville man who was to be released from prison Jan. 21 is now charged in a sexual assault that happened in March 2013.

James Eddie Smith Jr., 33, an inmate at the Hoke Correctional Institution on N.C. 211 outside Raeford, was charged Friday with second-degree rape and first-degree kidnapping.

Smith, whose home address was given as the 1000 block of Cain Road, was charged in April 2014 with larceny of a motor vehicle and driving while impaired, according to records from the N.C. Department of Public Safety. He was given a suspended sentence in May 2015 and placed on probation for two years.

In October, his probation was revoked and he was ordered to serve a 3-month sentence in prison.

Smith's bail was set at $500,000.
